Speechcraft ("Speechcraft", "we", "us") is operated by James Kelsall (the "Seller"). By accessing or using the Speechcraft website at speechcrafthq.com or any related service (the "Service"), you agree to these Terms & Conditions. If you do not agree, do not use the Service.

1. The Service

Speechcraft is an AI-powered tool that generates personalized speeches (wedding speeches, toasts, eulogies, and similar) from details you provide. You must be of legal age in your jurisdiction to use the Service, and if you use it on behalf of an organization you confirm you have authority to do so.

2. Account & Accuracy

You are responsible for keeping your account credentials confidential and for activity under your account. You agree to provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to misuse the Service, including by:

  • using it for unlawful, fraudulent, or harmful purposes;
  • infringing the intellectual property or privacy of others;
  • attempting to interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering, or circumventing technical limits);
  • generating defamatory, hateful, harassing, or otherwise unlawful content;
  • reselling or redistributing the Service or its outputs as a competing offering.

4. Generative AI — Inputs, Outputs & Responsibility

You are responsible for the prompts and information you submit and for how you use the generated outputs. You must have the rights to any personal details or content you input about third parties. Outputs are generated by AI and may contain inaccuracies; you should review and edit them before use. The Service is not a substitute for professional advice (legal, medical, financial, or otherwise).

We may remove or restrict content, refuse or filter outputs, and suspend accounts that violate these terms. Repeated infringement of third-party rights may result in termination. To report rights infringement, contact us at the address below.

5. Intellectual Property

Speechcraft and its underlying software, models, branding, and documentation are owned by the Seller and its licensors. Subject to your compliance with these terms, you receive a limited, non-exclusive, non-transferable right to use the Service and to use the speech outputs you generate for your personal or business purposes.

6. Payment Terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, cancellations, and refund mechanics are governed by Paddle's Checkout Buyer Terms in addition to these Terms.

7. Service Availability & Warranties

We work to keep the Service available but do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, the Seller's aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.

9. Indemnity

You will indemnify the Seller against claims arising from your content, your use of outputs, or your violation of these terms or applicable law.

10. Suspension & Termination

We may suspend or terminate your access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination you stop using the Service; sections that by their nature should survive (IP, liability, indemnity, governing law) will survive.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Seller's jurisdiction of residence, without regard to its conflict-of-laws rules. Disputes will be resolved by the competent courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.
